Ombudsman for the Telecom Sector

The COAI and the AUSPI have announced setting up of the office of the Telecom Sector Ombudsman (TSO) to address consumer grievances.

The Cellular Operators Association of India (COAI) and the Association of Unified Service Providers of India (AUSPI) have announced the setting up of the office of the Telecom Sector Ombudsman (TSO) to address consumer grievances.

According to S C Khanna, Secretary General of AUSPI, the first office of TSO will be set up in New Delhi, and will look into consumer grievances across the country.

It is learnt that Justice D P Wadhwa, a retired Supreme Court Judge, former Chairman of the National Consumer Commission, and former Chairman of the Telecom Dispute Settlement and Appellate Tribunal (TDSAT), will head the office of the TSO. And all operators, both private and state-owned, will be a part of this initiative.

In a joint statement, COAI and AUSPI said that the TSO is a good beginning for the introduction of an independent, cost effective, and generally effective dispute settlement body.

COAI and AUSPI also explained that subscribers would be able to contact the Ombudsman's office directly through written communication, email, phone, or fax. Significantly, no third party would represent the case. The TSO would function as private arbitrator and settlement authority, and would not be a legal forum with advocates representing the parties.

Meanwhile, the recommendation of the Ombudsman's office would be binding on all operators. However, subscribers who file the complaint can approach another forum if they are not satisfied with the recommendation.

According to T V Ramachandran, Director General of COAI, the Ombudsman scheme would be run as a 100 percent voluntary and self-regulatory industry initiative. They hope this scheme will meet a long standing need of telecom subscribers for a speedy, low-cost mechanism for redressal in case they are not satisfied with the response received from the company in question.

Cellular operators meanwhile, are optimistic that the TSO scheme will serve as a good beginning for an independent, cost effective, expeditious, and effective dispute settlement mechanism.

This sector is in need of Ombudsman, but it is to be worked out both by TRAI and COAI at the earliest. The Ombudsman must have the capability/authority to give orders.
