MMS Case: HC Allows Proceedings Against Accused

The controversial MMS clip hit headlines four years ago; it was said to contain explicit footage of two 17-year-old students from the Delhi Public School (DPS) at R K Puram engaging in a sexual act.

Remember the infamous MMS (multimedia messaging service) clip that created a furore back in 2004? The one showing two 17-year-old students from a Delhi school engaging in a sexual act?

At the time, the Delhi police filed an FIR (First Information Report) against the then managing director of Baazee.com (now eBay India Pvt Ltd) for allegedly illegally displaying the pornographic video clip on his company (Baazee) Web site.

The case has now returned to haunt Bajaj with the Delhi High Court yesterday allowing proceedings against the accused under sections 67 (publishing of information that is obscene in electronic form) and 85 of the Information and Technology Act.

In some relief to Bajaj though, the court quashed criminal proceedings against him under sections 292 (sale of obscene books) and 294 (obscene acts and songs in a public place) of the Indian Penal Code (IPC). Justice S Muralidhar however made it clear that the case under the Information and Technology Act -- for allowing auction of the obscene video clip -- would continue against Bajaj.

The girl's face was supposedly visible in the clip that circulated amongst fellow students, passing from one camera phone to the other, till it found it's way to the then Baazee.com. The clip was said to have been uploaded on the Web site by one IIT Kharagpur student.
