Derogatory Orkut Post Gets Man Arrested
Techtree News Staff Email Print
May 19, 2008
If you think you can get away with posting just about anything on your friendly social networking Web site, think again!

Rahul Krishnakumar Vaid's is a case in point. The 22-year-old IT professional from Gurgaon, Haryana, has been arrested by the cyber crime cell of the Pune police for posting obscene, derogatory content about Congress Chief Sonia Gandhi on Google's social networking Web site Orkut.

Vaid was charged under Section 292 of the Indian Penal Code and Section 67 of the Information Technology Act for posting vulgar content about Sonia Gandhi on an Orkut community titled "I hate Soniya Gandhi". The post was first seen by one Amol Bhokare, a 28-year-old Congress activist from Pune, who lodged a complaint with the Deccan Gymkhana police station in December last year.

Investigations revealed the IP address of the person who posted the message to be rahulvaidindia@gmail.com leading the Pune police to one Rahul Vaid from Chakarpur, Gurgaon city, Haryana. Vaid, an employee with Gurgaon-based 'PC Solutions' was nabbed by the police on Friday last week. He admitted to having posted the derogatory message on Orkut though he said he didn't think it would lead to a police case. Vaid was produced before the Shivajinagar court on Saturday, and has been remanded to police custody till May 21. If proven guilty, he could face imprisonment for up to five years and a fine to the tune of Rs 1 lakh.

Meanwhile, the perpetrator of the "I hate Soniya Gandhi" community on Orkut walks a free man (or woman); hating Sonia Gandhi is his/her personal opinion and having a personal opinion about someone, anyone, is not an offence as per the law.

The action taken by police is very appropriate, i m happy that culprits are not just going away after their deeds. U ppl say freedom of speech??...if u want to use ur freedom u should post ur home adress also after posting ur obscene. Writing anything and then hiding in anonymity is cowardice. Writing obscene for someone who is revered by others is definitely a punishable offence. There is a better language to express ur discontent over others. It is Soniya ji so u r having problem (biased mentality), and sympathy for Rahul, Had he written obscene for ur mother or sister would u not have complained to police? I think u would still say same –“freedom of speech—his right to abuse anybody”……I m not a congressman but respecting women is in India’s culture and offenders should be punished. This action will also contain other mischievous ppl.

What action has been taken , even Sonia Gandhi herself , against DMK leader M.Karunanidhi when he said " who is this Ram and from which engineering college did he pass out with an engineering degree ?" about Lord Sri Ram, the most revered God of millions of Hindus around the world ? Sonia Gandhi should have personally intervened in the matter and asked a young congressman like Mr.borade of Pune to file an FIR against Karunanidhi. But she kept silent ! What a shame ! And about our police force less said better it is ! Right under the nose of Sonia Gandhi heinous crimes take place in and around Delhi , the capital of India ! "Asatyameva Jayate" in India !

Woah...u seem to be smitten by sonia gandhi either or just trying to be different in this group here...!!! arent you..?? coz All here KNOW whats the indian culture and all know that RESPECT tO WOMEN is a considered. n by saying i hate someone..doesnt REALLY offend someone unless its a big celebrity specially if its from the freaking govt line.....we have the RIGHT of FREEDOm n can say what we feel..coz govt frankly hasnt done much for us to talk otherwise.......SO NO...i dont think there was a need to punish someone for saying he hates someone....and there are a LOT who will agree with me..n who shud as well..ifwe want the poor unfortunate Rahul to be saved from whats coming his way...ppl like ur thots..are just the shallow ones..who dont think of a bigger picture anyway..or else how could u miss out on all thats happening in the country n yet side someone for jus being said on a freaking internet community site a stupid comment - which really doesnt need our GOVERnMENT to take action when there are bigger and worst issues they shud be dealing with.... Its a Shame really that Sonia isnt doing anything about this..I am obviously not a COngress follower..but i had adored Sonia GAndhi....for what she was..looks like it was ALL IN VAIN...!!

Sonia gandhi or any other woman in that case, my question remains the same, how would Indian Police catch the culprit if the crime was committed in a cyber cafe? Anyone having any suggestions on this?

What if the crime was committed at cyber caf? how will the Indian Police track it down? They can go down to the location of the caf? but can they get to the actual person who has committed the crime. And in such case is it fair to close down the cyber caf?? Well after all the cyber caf? owner wont go to check out as to what everyone is doing. If one has to do net at Sify, he/she should have account to do net. I guess every cyber caf? should be asked to do the same. Cyber caf? should be licensed. As of now I can think of these 2 solutions only.

what an irony...our police travels from one state to another in just no time to catch hold of a man who posts vulgur comments on the website, but what does the same police force do to catch people who are involved in grave crimes and take away people's life...??? india can never progress when it comes to the fairness and its judicial system. hang people like manu sharma and vikas yadav who took away innocent lives.....

what rahul did was immature on his part. he wasn't aware of the dire consequences, and therefore he should be let off without any punishment. had he been aware that such a thing would land him in trouble, he would have never done such an act. humans tend to act irrational at times and they should be forgiven. moreover, he did not curb anyone's right to life or liberty.

Zist of the matter is whatever Rahul did is wrong i.e. putting obscene material in a social network of a citizen of india or to be precise a "woman".Nobody can argue that this is right. Although their is another phase to it, the police acted very promptly to it as the lady in question is of very high importance and stature, why can't the treat the other citizens the same way.Today the ordinary citizen doesn't want to get involed with police even if something is stolen, someone misbehaved or say bigger crimes....The only objective of police is to extract benefit from the parties involed. We are the only country in world where u have to bribe police to do their own work not some extra work until unless u are having a political background. And some people are saying why don't u come and join politics and make it better, i ask them will they have the determination to become doctors, engineers or scientist and really help the country or they have only joined politics to make it worse and do good only for their own gaining more power to harass others????????????

fighting for the names of Sonia Gandhi and bal thakare's will not help anyone. i wish MR.Amol Bhokare, a 28-year-old Congress member should have followed their so called gandian philosphy and should have tried to relize rahul his mistake rather than using it for his political gains.

i guess this is not such a big crime that you have to pay a fine of 1 lac or 5 years of jail. he should be warned first and such material should be removed if its vulgur .. putting someone behind bars only will not help.

you should appreciate the police, for their job. Everything has a limit if everyone in the name of freedom starts writing and creating hate groups then we would have jihads in every corner of our country. ofcourse the police need to improve, and young people like you and me should join politics and save our country. not be winning at our police

This is ridiculous. Rahul is no ways at fault. He and so does every person in India have the right to express themselves in public. In fact the activist who complained should be put behind bars. BJP and Shivsena activists should consider this unlawful deed of the Congress and act against them.
